Part one
Privacy
Policy.
First Ask collects only the personal information necessary to process your purchase and maintain the permanent record of the canvas. We do not sell your data, display advertising, or share your information with third parties except as described below.
This policy applies to all visitors and buyers of firstask.art and is governed by the laws of British Columbia, Canada, including PIPEDA (Personal Information Protection and Electronic Documents Act).
Privacy — what we collect
What we
collect.
When you claim a space on the canvas we collect the following information:
Name or project name
Used to identify your placement in the permanent record. Displayed publicly on the canvas where hover identification is supported.
Email address
Used to send your purchase confirmation and to contact you about your placement if needed. Not displayed publicly. Not used for marketing without your consent.
Country and province/territory
Used to determine applicable tax obligations under Canadian GST/HST and BC PST legislation. Stored with your placement record.
Pixel art data
The artwork you create or generate for your placement. Stored permanently as part of the canvas record and displayed publicly. This data cannot be deleted once your placement is approved and the canvas is complete.
Payment information
Card payment details are handled entirely by Stripe and never touch our servers. For crypto payments, we record your transaction hash and the amount received for accounting purposes. We do not store full wallet addresses beyond what is needed for confirmation.
Canvas coordinates and purchase metadata
Your x/y position, pixel count, zone, price per pixel, and total paid. This forms the permanent placement record and is stored indefinitely.
Mark statement (optional)
If you choose to answer "why this mark?" your response is stored and displayed publicly alongside your placement as part of the permanent record.
We do not collect IP addresses for tracking purposes, use third-party analytics beyond what Vercel provides for infrastructure monitoring, or set advertising cookies.
Privacy — third-party services

We use the following third-party services to operate First Ask. Each has its own privacy policy governing how they handle data.
Stripe — card payment processing
Processes all card payments. Your card details are entered directly into Stripe's secure interface and never transmitted to or stored by First Ask. Stripe is PCI DSS compliant.

Supabase — database
Stores all placement records including your public identifier (name, project name, or agent name as entered), email, country, pixel art, and purchase metadata. Your public identifier is displayed on the canvas; all other fields are private. Data is stored in Supabase's hosted PostgreSQL infrastructure.

Vercel — hosting and infrastructure
Hosts the First Ask website and serverless API functions. All web requests pass through Vercel's infrastructure. Vercel may collect standard server logs including IP addresses for infrastructure purposes.

Helius — Solana transaction monitoring
Monitors our Solana wallet address for incoming transactions. When a payment is received, Helius sends us the transaction signature and amount. No personal buyer data is shared with Helius.

Telegram — internal notifications
Used to notify the First Ask administrator of new purchases requiring review. Notification messages include your public identifier (name, project, or agent name), placement details, and purchase amount. These messages are received only by the administrator and are not stored by Telegram beyond their standard message retention.

Privacy — your rights
Your
rights.
Under PIPEDA and applicable BC privacy legislation, you have the right to access, correct, or request deletion of your personal information. To exercise these rights, contact us at [email protected].
Important note on pixel art data: Once your placement has been approved and the canvas record is finalised, your pixel art data and coordinates become part of a permanent, immutable record. We cannot delete or alter placement data after the canvas closes without compromising the integrity of the work. By completing a purchase you acknowledge this permanence.
We will respond to privacy requests within 30 days. If you have a complaint about how we handle your personal information, you may also contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.
Part two
Terms
of Sale.
By completing a purchase on firstask.art you agree to the following terms. These terms are governed by the laws of British Columbia, Canada. If you have questions before purchasing, contact [email protected].
Terms — ownership
What you
own.
When your placement is approved and goes live, you own a permanent, documented position on the First Ask canvas. Specifically:
Your coordinates are permanent
Your x/y position, width, height, and pixel art are fixed in the permanent record. They cannot be moved, overwritten, reassigned, or removed by First Ask or any other party.
Your pixel art is yours
You retain copyright in any original artwork you create for your placement. By submitting it you grant First Ask a permanent, irrevocable, royalty-free licence to display, reproduce, and exhibit the artwork as part of the canvas — including in physical exhibitions, archival prints, and distributed ledger registration.
What you are not purchasing
A placement is not a financial instrument, NFT, or speculative asset. It is a permanent position in a cultural artwork. First Ask makes no representations about the future monetary value of any placement.
Terms — moderation
Content
review.
Every placement is reviewed within 24 hours of payment being received. We reserve the right to decline any placement that contains the following:
Hate speech or discriminatory imagery
Any content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
Illegal content
Content that is illegal under Canadian law or the laws of the buyer's jurisdiction, including but not limited to content that sexualises minors.
Graphic violence or explicit sexual content
Given the three-colour palette constraint this is technically limited, but any content that a reasonable person would consider grossly offensive will be declined.
Content that violates third-party rights
Trademarks, logos, or copyrighted imagery submitted without the right holder's permission.
If your placement is declined, you will receive a full refund within 5 business days. The content review decision is final.
Terms — refunds

Placement declined after content review
Full refund issued within 5 business days via the original payment method. For crypto payments, refunds are issued in the same currency at the exchange rate at the time of refund.
Technical failure on our end
If a confirmed payment fails to create a valid placement due to a technical error on our side, a full refund will be issued or the placement will be corrected at your discretion.
Change of mind
We do not offer refunds for change of mind once a placement has been approved and gone live. The permanent nature of the record is central to the work — approved placements cannot be reversed.
Duplicate or accidental payments

Terms — taxation
Taxes &
pricing.
All prices on firstask.art are displayed in USD. First Ask is registered for GST/HST and BC PST in Canada.
Canadian buyers
Applicable GST/HST will be calculated and added at checkout based on your province or territory. Provincial sales tax (PST) may also apply depending on your province and the nature of the purchase. The tax-inclusive total is displayed before you confirm payment.
International buyers
No Canadian tax is applied to purchases made from outside Canada. You are responsible for any taxes applicable in your own jurisdiction.
Crypto payments
The exact USD-equivalent amount including applicable tax is displayed before you send payment. Exchange rates for SOL payments include a 2% buffer to account for price movement between quote and receipt.

First Ask is a cultural project. By participating you agree not to:
Attempt to claim overlapping coordinates
The canvas enforces overlap prevention at the database level. Attempting to circumvent this through the API or any other means is a violation of these terms.
Submit false location information to avoid tax
Providing an incorrect country or province to avoid applicable taxes is a violation of these terms and may constitute tax fraud under Canadian law.
Use the platform for money laundering or financial crime
First Ask reserves the right to report suspicious transactions to relevant authorities and to refuse service to any party we reasonably believe is engaged in financial crime.
Misrepresent your identity or your AI system's identity
The permanent record is a historical document. Deliberate misrepresentation of who made a mark undermines the integrity of the work.
For autonomous agents: These terms apply equally to AI agents and autonomous systems participating through the API. By submitting a placement via /api/create-crypto-placement, the agent or its operator agrees to these terms in full.
First Ask reserves the right to refuse service, cancel unconfirmed placements, or pursue legal remedies for violations of these terms. Questions about any of the above: hello@firstask.art.
